Web design is something that is easy to learn but tough to master. The principles itself are easy but when it comes to making a site that not only looks good but is also functional can present some difficulties to even the most advanced web designer.

A good friend, a lawyer, once told me that the power of a contract is not in specifying what will happen, but in specifying what will happen if what's supposed to happen DOESN'T happen. For example: "If client responses to designer requests are NOT timely, any projected completion dates are void and full payment is due in 10 days." It may seem a bit brutal, but it sure keeps things rolling along.

We have implemented a pay-before work schedule. Before moving on the next phase of a project, we bill for that phase in advance. That keeps serious clients and weeds out those who could be trouble. Then, the project moves smoothly and we get paid faster since the project does not proceed without it. We can also deliver without waiting for payment. There is no refund policy on advance payments and we justify that by explaining that if a client cancels, we could have filled that space with another project. Otherwise, under a typical situation, canceling could incur a fee (due to wasted time, etc), and try to get a client to pay that!

Otherwise, i agree with all points above!
